SPECIAL TOWN MEETING – June 22, 2004

TOWN OF BAR HARBOR

 

 

            The voters of the Town of Bar Harbor met in the Municipal Building Auditorium, Bar Harbor, Maine on Tuesday, June 22, 2004.  There were approximately 65 registered voters present.  The special town meeting was called to order at 7:04 p.m. by Town Clerk Patricia A. Gray, who called for action under Article 1.

 

ARTICLE 1 ELECTION OF MODERATORTo choose a Moderator to preside at said meeting.  The Town Clerk opened the floor for the election of Moderator.  It was moved and duly seconded that Chad Smith be nominated as Moderator.  There being no other nominations, it was duly moved and seconded that nominations cease.  Motion passed.  Ballots were cast for Moderator and Chad Smith received four votes, a unanimous vote, and was declared elected.  He was sworn in by the Town Clerk.

 

Following a review of Town Meeting procedures, the Moderator called for the Warrant Committee’s report.  Millard Dority, Chairman of the Warrant Committee, moved, and it was duly seconded, that the Warrant Committee recommended that the Town appropriate Eight Hundred Thousand dollars ($800,000) to provide for the replacement of the retaining wall above the Town Beach, construction of a beach access ramp and landscaping of Agamont Park and finance the project as set forth in paragraphs 1, 2, 3, and 4 of Article 2.

 

 

ARTICLE 2 –TOWN BEACH WALL REPLACEMENT FINANCING - To see if the Town of Bar Harbor will adopt the following vote:

 

(1)   That a capital improvement project consisting of replacement of the retaining wall above the Town Beach, construction of a beach access ramp and landscaping of Agamont Park is hereby approved; and

 

(2)   That a sum of $800,000 is hereby appropriated to provide for the costs of said improvement project; and

 

(3)   That the Treasurer and Chairman of the Town Council, acting pursuant to the provisions of 30-A M.R.S.A. §5772, are hereby authorized to issue general obligation securities of the Town of Bar Harbor (including temporary notes in anticipation of the sale thereof) in an aggregate principal amount not to exceed Eight Hundred Thousand and 00/100 Dollars ($800,000.00); and

 

(4)   That the discretion to fix the date(s), maturity(ies), interest rate(s), denomination(s), place(s) of payment, form and other details of said securities, including execution and delivery of said securities on behalf of the Town of Bar Harbor, and to provide for the sale thereof, is hereby delegated to the Treasurer and Chairman of the Town Council.

 

FINANCIAL STATEMENT

 

1.         Total Town Indebtedness

                        a.     Bonds outstanding and unpaid (June 1, 2004)                            $14,627,881

                        b.     Bonds authorized and unissued                                                             $-0

                        c.     Bonds to be issued if this article is approved                                  $800,000

 

2.         Costs

At an estimated maximum interest rate of 5.0% for a twenty (20) year maturity, the estimated costs for this bond issue will be:

 

                                          Principal                                        $800,000

                                          Interest                                          $483,881

                                          Total Debt Service                        $1,283,881

 

3.         Validity

            The validity of the bonds and the voters' ratification of the bonds may not be affected by any error in the above estimates.  If the actual amount of the total debt service for the bond issues varies from the estimates, the ratification by the voters is nevertheless conclusive and the validity of the bond issue is not affected by reason of the variance.

Planning Director Anne Krieg, followed up by Keith Whitaker, Engineer of Plymouth Engineering, Inc., gave a presentation of the town wall and Agamont Park project from the being with the Waterfront Master Plan of 1996 to the proposed project. 

 

Following brief comments from the public, the moderator restated the motion and called for a voice vote.  The motion passed overwhelming, with only a few nay voices.

 

VOTED:  That the Town appropriate Eight Hundred Thousand dollars ($800,000) to provide for the replacement of the retaining wall above the Town Beach, construction of a beach access ramp and landscaping of Agamont Park and finance the project as set forth in paragraphs 1, 2, 3, and 4 of Article 2.

 

Ken Smith, seconded by Val Scott, moved to adjourn the meeting at 7:45 p.m.  Motion carried.
