SPECIAL TOWN MEETING - January 5, 2004

TOWN OF BAR HARBOR

 

            The voters of the Town of Bar Harbor met in the Municipal Building Auditorium, on Monday, January 5, 2004.  There were approximately 100 registered voters present.  The special town meeting was called to order at 7:10 p.m. by Town Clerk Patricia A. Gray, who called for action under Article 1.

 

ARTICLE 1 ELECTION OF MODERATORTo choose a Moderator to preside at said meeting.  The Town Clerk opened the floor for the election of Moderator.  It was moved and duly seconded that Chad Smith be nominated as Moderator.  There being no other nominations, it was duly moved and seconded that nominations cease.  Motion passed.  Ballots were cast for Moderator and Chad Smith received four votes, a unanimous vote, and was declared elected.  He was sworn in by the Town Clerk.

 

The moderator noted that the Warrant and the Public Notice of the Warrant showed the decimal off in Article 2 of the first paragraph, however, it was correct and spelled out in the remaining paragraphs.  It was clear the amount requested and voted on was $2,330,000.00 (Two Million Three hundred Thirty Thousand dollars and no/100).

 

Helen Caivano, Chairman of the Bar Harbor School Committee, and duly seconded by Bill Dohmen, Chairman of the Warrant Committee, moved that we appropriate up to $2,330,000 to provide for the costs of replacement of and renovation to the heating ventilation systems of the Conners-Emerson School and finance the project as set forth in paragraphs 1, 2, and 3 of Article 2.

 

ARTICLE 2 –CONNERS-EMERSON SCHOOL RENOVATION PROJECT - Shall the following vote be adopted? 

            (1)       An appropriation of funds is hereby approved in the amount of $2,330,000.00 to provide for the costs of a School Improvement Project consisting of renovations and improvements to the Conners-Emerson School Buildings, including replacement of and renovations to the heating and ventilation systems and conversion from steam to hot water heating systems; and

 

            (2)       To finance the project, the Treasurer and Chairman of the Town Council, acting pursuant to the provisions of 30-A M.R.S.A. §5772, are hereby authorized to issue, at one time or from time to time, general obligation securities of the Town of Bar Harbor (including temporary notes in anticipation of the sale thereof) in an aggregate principal amount not to exceed Two Million Three Hundred Thirty Thousand Dollars ($2,330,000.00); and

 

            (3)       Discretion is delegated to the Treasurer and Chairman of the Town Council to fix the date(s), maturity(ies), interest rate(s), denomination(s), callable features, place(s) of payment, form and other details of said securities, including execution and delivery of said securities on behalf of the Town of Bar Harbor, and to provide for the sale thereof.

 

 

FINANCIAL STATEMENT

 

1.         Total Town Indebtedness

                        a.     Bonds outstanding and unpaid (12-2-03)                              $12,616,805

                        b.     Bonds authorized and unissued                                        $     250,000

                        c.     Bonds to be issued if this article is approved                     $      2,330,000

 

2.         Costs

At an estimated maximum interest rate of 5.0% for a twenty (20) year maturity, the estimated costs for this bond issue will be:

                                          Interest                   1,409,305

                                          Total Debt Service           3,739,305

 

3.         Validity

            The validity of the bonds and the voters' ratification of the bonds may not be affected by any error in the above estimates.  If the actual amount of the total debt service for the bond issues varies from the estimates, the ratification by the voters is nevertheless conclusive and the validity of the bond issue is not affected by reason of the variance.

Each member of the School Committee gave an overview of their decision and recommendation.  Bill Dohmen, Warrant Committee Chairman, spoke of the Warrant Committee’s reasoning and recommendation.  Following an end to the brief comments from the public, the moderator restated the motion and called for a voice vote.  The motion carried overwhelming, with only a few nay voices.

 

VOTED: That the Town appropriate up to $2,330,000 to provide for the costs of replacement of and renovation to the heating ventilation systems of the Conners-Emerson School and finance the project as set forth in paragraphs 1, 2, and 3 of Article 2.

 

Ken Smith, and duly seconded, moved to adjourn the meeting at 7:47 p.m.  Motion carried.
