ANNUAL TOWN MEETING - MAY 5 & 6, 2003

TOWN OF BAR HARBOR

 

            The voters of the Town of Bar Harbor met at the Annual Town Meeting in the Municipal Building Auditorium, Bar Harbor, Maine on Monday, May 5, 2003.  The meeting was called to order at 8:00 a.m. by the Town Clerk.  The following ballot clerks, having been appointed and duly sworn, were in attendance for the election:  (Republican)  Eleanor Raynes; Helen Wood; and (Democrat) Anna Ryan; Barbara Boyington; and Richard Hirte; and (Green Independent) Alice Long. 

 

            The action taken by the meeting under the various Articles in the Warrant was as follows:

 

Article  1  ELECTION OF MODERATOR - To choose a Moderator to preside at the meeting.

 

                  The Town Clerk opened the floor for the election of Moderator.  It was duly moved and seconded that Chad Smith be nominated as Moderator, there being no other nominees, it was duly moved and seconded that nominations cease.  Motion passed. Ballots were cast for Moderator and Chad Smith received five votes, a unanimous vote, and was declared elected and sworn in by the Town Clerk.  Mr. Smith made an appointment of Deputy Moderator, as duly elected Moderator of the Bar Harbor Annual Town Meeting, Mr. Smith appointed Carolyn Eaton, duly sworn to serve in his place in his absence from the polls during Town Meeting election.

 

                  The Moderator called the meeting to order and presided.  The following action was taken:

 

 

 

Article 2      ELECTION OF OFFICERS - To elect all necessary Town Officers as are required to be elected by secret ballot.

 

426 ballots were cast including 34 absentee ballots.  There were no spoiled ballots.

 

For Town Council Member – Three Year Term – Two vacancies

 

Joseph M. Cough            received                      272 votes

Michael J. Good             received                      158 votes

Matthew R. Horton         received                      320 votes

 

Each of the following write-ins received one vote each:  Colin Capers, Robert V. Collier, Matt Gerald, William McFarland, Steve Perrin, Joyce Peterson, Ron Wrobel.

 

Joseph M. Cough and Matthew R. Horton were declared elected.


 

For Superintending School Committee – Three Year Term – One vacancy

 

Paul G. Murphy                          received                      355 votes

 

There were two invalid write-in votes and five votes cast as follows:  J. Thomas Burton III (3), Nancy Corliss (1), and Liston Higgins (1).

 

Paul G. Murphy was declared elected.

 

 

For Mount Desert Island District Trustee – Three Year Term – One vacancy

 

Vernon S. McFarland, Jr.           received                      362 votes

 

Each of the following write-ins received one vote: J. Thomas Burton, Amanda Kendall, David Lind, Laurel Robbins, and Artie (Milford) Shaw.

 

Vernon S. McFarland, Jr. was declared elected.

 

 


Article 3      LAND USE ORDINANCE AMENDMENT:  Parking Requirements for Restaurants – Shall the Bar Harbor Code, Chapter 125, Land Use Ordinance, be amended as follows:

§ 125-67.  General review standards.

D.        Parking requirements. Any site plan for an activity that can be expected to generate vehicular traffic shall provide for off-street parking in accordance with the following:

(3)       The following minimum off-street parking shall be provided and maintained in the case of new construction, alterations or changes of use which would increase the parking demand according to the standards set forth below, or any increase in the area used which increases the number of persons using the premises. In the event of such construction, alterations, change or increase, the entire premises or use, and not just that portion constructed, altered, changed or increased, shall become subject to the following requirements.

(g)       Restaurants, eating and drinking establishments: six four (4) spaces per 1,000 square feet of net gross leasable area; Downtown Business Districts are required to provide three (3) spaces per 1,000 square feet of gross leasable area.

 

(h)       Restaurants, eating and drinking establishments - take out: three two parking spaces per 1,000 square feet of net gross leasable area.

 

 

Recommendation:

The Planning Board recommends approval, by a vote of 7 to 0.

The Warrant Committee recommends approval, by a vote of 16 to 0.

 

VOTED:  This article passed by the following votes:

Article 4         LAND USE ORDINANCE AMENDMENT: Major and Minor Site Plan Review – Shall the Bar Harbor Code, Chapter 125, Land Use Ordinance, be amended to segregate Major Site Plans from Minor, delegating authority for review of Minor Site Plans to the Planning Director as described in “Proposed Changes to Major and Minor Site Plan Review”, 14 page document, dated February 4, 2003, a copy of which is on file in the Town Clerk’s Office.

 

Recommendation:

The Planning Board recommends approval, by a vote of 7 to 0.

The Warrant Committee recommends approval, by a vote of 16 to 0.

 

            VOTED:  This article passed by the following votes:
